1. Scope and Data Controller

1.1 Scope

This Policy applies to personal data processed by Clipraze in connection with the Service, including data provided by users, creators, visitors, and business contacts. By accessing or using the Service, you acknowledge the data practices described in this Policy.

1.2 Data Controller

Clipraze LLC is the data controller for personal data processed in connection with the Service. Where EU or UK data protection law applies, Clipraze LLC acts as data controller for personal data collected directly from users.

2. Data We Collect

2.1 Data You Provide

Account data: first name, last name, email address, password (hashed, never stored in plain text), date of birth (required to confirm you are 18 or older), and profile or channel details you choose to add.
Creator and payout data: if you request withdrawals or monetization payouts, we collect identity-verification information such as government-issued ID images, payment or bank account details, and any tax documentation required by law or by our payment processors.
Content and communications: videos, audio, thumbnails, comments, captions, support messages, reports, and appeals you submit.
Paid content and subscription data: purchase history and billing records for premium content, subscriptions, and similar transactions.
Marketing and consent records: your communication preferences and cookie or similar consent choices. When you Allow, Reject, or later change cookie preferences, we store that choice on our servers with the date, IP address, browser details, a visitor identifier, and your account if you are logged in. We keep this log to demonstrate consent and handle privacy requests.

Accounts can be created only through our email registration process. Social or third-party login is not currently offered.

2.2 Data Collected Automatically

Device and log data: IP address, approximate location derived from IP (such as city, country, and coordinates), browser type, operating system, timestamps, and referral URLs.
Usage data: pages and videos viewed, watch history, search queries, clicks, likes, shares, comments, subscription activity, session duration, and feature interactions.

2.3 Data from Third Parties

Payment processors and fraud-detection providers for transaction verification.
Analytics providers, but only if you allow analytics cookies (see Section 5).
Rights holders, law enforcement, or public sources when required for safety, legal compliance, or intellectual-property enforcement.

3. How We Use Personal Data

We process personal data to:

Create and manage your account and provide the Service.
Authenticate users, detect fraud, and secure accounts.
Confirm you meet the 18+ age requirement.
Host, process, transcode, and distribute your uploaded content.
Enable creator monetization features including ad revenue share, paid subscriptions, and premium content sales.
Process creator payouts, perform KYC identity verification, fulfill tax reporting obligations, and prevent payout fraud.
Serve ads using our internal advertiser system based on contextual signals and platform usage. We do not sell your personal data to third-party advertisers.
Personalize content recommendations, search results, and the user experience.
Send you service notifications, security alerts, policy updates, and (where you have opted in) marketing communications.
Respond to support requests, enforce our Terms of Service, and resolve disputes.
Detect, investigate, and prevent abuse, illegal activity, and policy violations.
Comply with legal and regulatory obligations.
Conduct internal analytics, audits, and product improvement.

Where applicable law requires a legal basis, we rely on:

Contract performance: to provide the Service, manage your account, and process payouts.
Legitimate interests: platform safety, fraud prevention, product improvement, and internal analytics — balanced against your rights and interests.
Consent: for non-essential cookies and marketing communications where required by law. You may withdraw consent at any time without affecting the lawfulness of prior processing.
Legal obligation: to comply with tax, financial, law enforcement, and other regulatory requirements.
Vital interests or public interest where applicable in limited circumstances.

5. Cookies and Tracking Technologies

We use cookies and similar technologies for:

Essential functionality: session management, login state, security, and remembering your cookie choice. These are necessary for the Service to work.
Analytics and performance: optional tools such as Google Analytics, loaded only if you click Allow.
Support chat: optional tools such as a live-chat widget, loaded only if you click Allow.
Advertising: ads are served through our internal advertiser system. We do not use third-party advertising networks to target you with cross-site ads.

Non-essential cookies are not set until you choose Allow. If you choose Reject non-essential, we keep only essential cookies.

You can change your choice at any time with Cookie Settings in the website footer or on the Cookie Policy page. We also honor Global Privacy Control (GPC) signals as an opt-out of non-essential cookies.

We may share personal data with:

Service providers: hosting, content delivery, cloud storage, customer support, content moderation, fraud prevention, analytics (if you allowed analytics cookies), and communication services — bound by confidentiality and data-processing obligations.

We do not sell personal data for money. If any sharing of data for cross-context behavioral advertising is considered a "sale" or "share" under applicable law (including the CCPA/CPRA), we provide rights and opt-out controls as described in Section 11. You may opt out by rejecting non-essential cookies, using Cookie Settings, or sending a GPC signal.

7. Creator KYC and Payout Data

Creators who want to withdraw earnings must complete identity verification. This may include government-issued ID and tax documentation required by law or by our payment processors. This data is:

used for identity verification, payout processing, tax compliance, and fraud prevention;
reviewed by Clipraze and, where needed, shared with payment processors and tax authorities;
retained for the periods required by applicable financial, tax, and anti-money-laundering laws.

Providing a false date of birth at registration does not avoid this check. We may refuse or reverse payouts if identity or age cannot be verified.

8. Paid and Mature Content

Purchase records for paid or premium content, including mature-themed content, are processed for transaction fulfillment, fraud prevention, and chargebacks. Viewing history for paid content is treated as sensitive usage data and is not used for external advertising targeting.

9. User Content Visibility

Profile information, channel names, and uploaded content may be publicly visible depending on your account and content settings. Do not upload sensitive personal data you do not wish to be publicly accessible.

10. Data Retention

We retain personal data only as long as needed for the purposes described in this Policy, including:

Account data: for the lifetime of your account. After you delete your account, we anonymize profile information and keep only what is required for safety, fraud, tax, payout, legal, and backup purposes.
Payout, KYC, and tax data: for the periods required by applicable tax, financial, and anti-money-laundering laws (often several years).
Log and security data: for a limited period needed for security and abuse prevention.
Legal holds: longer where required by active investigations, litigation, or regulatory requests.

When data is no longer needed, we delete or anonymize it.

11. Your Privacy Rights

Depending on your location, you may have the right to:

Access the personal data we hold about you.
Correct inaccurate or incomplete personal data.
Delete your personal data (subject to legal retention requirements). You can also delete your account in Security Settings.
Restrict or object to certain types of processing.
Data portability — request a copy of your data by contacting us.
Withdraw consent at any time where processing is consent-based, including through Cookie Settings.
Opt out of sale or sharing of personal information for cross-context behavioral advertising.
Non-discrimination — we will not discriminate against you for exercising your privacy rights.

We will respond within the timeframes required by applicable law (typically 30–45 days). We may need to verify your identity before fulfilling a request.

11.1 California Residents (CCPA / CPRA)

California residents have the right to:

Know what categories of personal information we collect, use, disclose, or sell.
Access specific personal information collected about them.
Delete personal information, subject to exceptions.
Correct inaccurate personal information.
Opt out of the sale or sharing of personal information.
Limit use and disclosure of sensitive personal information where applicable.
Non-discrimination for exercising CCPA rights.

You may also opt out by rejecting non-essential cookies, using Cookie Settings, or enabling a Global Privacy Control signal in your browser.

12. International Data Transfers

Your data may be processed in the United States and other countries where our service providers operate. If you access the Service from another country, your information is transferred to the United States. Where required by applicable law, we use the transfer safeguards permitted for that transfer.

13. Security

We implement administrative and technical safeguards designed to protect personal data from unauthorized access, disclosure, alteration, or destruction. These include access controls, encryption in transit (TLS), hashed password storage, encryption of KYC data at rest, and security monitoring. No method of transmission or storage over the internet is 100% secure. We cannot guarantee absolute security.

14. Children and COPPA

The Service is for users 18 years of age or older. We do not knowingly collect personal data from anyone under 18.
The Service is not directed to children under 13.
If we become aware that we have collected personal data from a person under 18, we will delete that data and disable the associated account, unless retention is required by law.
Parents or guardians who believe a minor has provided personal data to us should contact privacy@clipraze.com immediately.

15. Do Not Track and Global Privacy Control

Our Service does not respond to the older browser Do Not Track (DNT) header, because no universal standard for that signal has been adopted. We do honor Global Privacy Control (GPC) signals as an opt-out of non-essential cookies and of any sale or sharing of personal information.

16. Third-Party Links and Services

The Service may link to or integrate with third-party websites, payment processors, and (if you allow non-essential cookies) analytics or chat tools. Their privacy practices are governed by their own privacy policies, not this one.

17. Changes to This Policy

We may update this Policy from time to time. Material changes will be communicated by updating the "Last Updated" date and posting notice on the Service. Where required by law, we will notify you directly.
